1. Agreement to Terms
By accessing or using Popwis (“the Service”) at popwis.net, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Popwis is a Software as a Service (SaaS) website conversion toolkit that provides social proof notifications, popup forms, visitor feedback collection, exit intent offers, shipping bars, spin wheels, countdown timers, contact management, calendar scheduling, AI-powered automated workflows, social media publishing, and related conversion optimization tools for websites and online stores. The Service integrates with third-party platforms to extend workflow and data synchronization capabilities.
3. Subscriptions and Billing
Popwis offers both free and paid subscription plans. Paid plans are billed monthly. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis.
All payments are processed securely through Lemon Squeezy, our payment provider. Prices are listed in USD and may be subject to local taxes.
4. Cancellation and Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months of service.
If you believe you have been charged in error, please contact us at hello@popwis.net within 7 days of the charge.
5. Acceptable Use
You agree not to use Popwis to:
- Violate any applicable laws or regulations
- Display false, misleading, or deceptive notifications
- Collect personal data without proper consent from your visitors
- Send spam or unsolicited communications
- Attempt to reverse engineer or compromise the Service
- Resell or sublicense the Service without permission
6. Third-Party Integrations
The Service allows you to connect third-party accounts to extend workflow and data synchronization capabilities. By connecting a third-party account, you authorize Popwis to access and use data from that service as needed to perform the actions you configure. Supported integrations include:
- E-Commerce: Shopify, WooCommerce, BigCommerce
- Email Marketing: Mailchimp, Klaviyo
- Google: Gmail, Google Sheets, Google Drive, YouTube
- Microsoft: Outlook, OneDrive
- Social Media: Facebook, Instagram, Twitter/X, LinkedIn, TikTok, Pinterest
- Productivity: Notion, Airtable
- Databases: MongoDB, Firebase Firestore, PostgreSQL
- Storage: AWS S3, Cloudflare R2, Dropbox
- Communication: Twilio (SMS & WhatsApp)
- Automation: Zapier
- AI Providers: OpenAI, Anthropic, Google Gemini, DeepSeek
You are responsible for complying with the terms of service of any third-party platforms you connect. We are not responsible for the availability, accuracy, or policies of third-party services. You may disconnect any integration at any time from the Integrations page.
7. Your Data and Privacy
You retain ownership of all data you collect through Popwis widgets, including contact emails and visitor information. By using the Service, you are responsible for ensuring your use of collected data complies with applicable privacy laws including GDPR and local regulations.
Our collection and use of your account data is governed by our Privacy Policy.
8. Intellectual Property
The Service, including its design, code, features, and content, is owned by Popwis and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.
You retain full ownership of any content you create using the Service, including notification messages, form content, and collected data.
9. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime without prior notice. We are not liable for any losses resulting from Service unavailability.
10. Limitation of Liability
To the maximum extent permitted by law, Popwis shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.
Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.
11. Disclaimers
The Service is provided “as is” without warranties of any kind. We do not guarantee that the Service will meet your specific requirements or that conversion results will meet your expectations. Results vary based on your website, audience, and configuration.
12. Account Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination where technically possible.
13. Changes to Terms
We may update these Terms at any time. We will notify you of significant changes via email or a notice in the dashboard. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by applicable international law. Any disputes shall be resolved through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration.
